Terms and Conditions
Ownership Of Materials
These terms and conditions form the contract (“Contract”) between you and Armadillo for the supply of goods and services.
Please read these terms and conditions carefully and ensure that you agree to them. If you have any questions please contact Armadillo’s customer services team by writing to the address below.
- Armadillo
Armadillo’s registered company name is Armadillo Concepts UK Limited and its registered office is at Unit 3, Haviland Road, Ferndown Industrial Estate, Wimborne, Dorset BH21 7RZ. Company Number 425 4275 - Unfitted Goods
- Price: The price of goods which are supplied without fitting (‘Unfitted Goods’) is available on request and is quoted exclusive of VAT.
- Payment: Payment for the Unfitted Goods is due at the time of order. Payment shall not be deemed to have been made until cleared funds are received in Armadillo’s bank.
- Delivery: Unfitted Goods will be dispatched as soon as is reasonably practicable, usually the next working day. If the Unfitted Goods cannot be dispatched within a reasonable time we will contact you to give you an estimated delivery date. Once the goods have been delivered to the delivery address they are at your own risk and Armadillo will not be liable for their loss or destruction.
- Any damage MUST be reported at the time of delivery. Goods that have been signed for as received in good condition will NOT be refunded.
- Do not accept product if the exterior packaging is damaged.
- Fitted Goods
- Price: The price of goods which are to be supplied and fitted by Armadillo (‘Fitted Goods’) shall be the total of the price of the goods and the price of the fitting which is available on request and is quoted exclusive of VAT.
- Payment: Payment for the Fitted Goods is due on the date of fitting. Payment shall not be deemed to have been made until cleared funds are received in Armadillo’s bank. You are not entitled to withhold payment of the price or to claim set off against any payments due to Armadillo.
- Delivery: Where you have placed an order for fitted goods you will be contacted by Armadillo to arrange a mutually convenient date for the goods to be fitted, subject to the availability of Armadillo’s staff and the availability of the goods. It is your responsibility to deliver your vehicle to Armadillo to enable the fitting services to take place.
- Cancellation Rights
You may cancel your order within 14 working days of communicating your order to Armadillo providing that any cancellation shall be notified to Armadillo in writing and that any goods supplied have been returned, in good saleable condition in their original packing material with seals unopened, to Armadillo’s address as set out above. You must obtain proof of delivery for any returns to Armadillo. Refunds for goods returned in good condition with seals unbroken will be made as soon as reasonably possible after receipt of the goods. You shall be responsible for the costs of returning the goods to Armadillo, except in the case where the goods are returned for one of the following reasons: - The goods supplied are different to the goods ordered: or
- The goods are being returned in connection with a failure to comply with statutory rights as set out at 5.2.
- Roll-Top Cover – Warranty
- All parts (‘Armadillo Parts’) supplied by Armadillo have been supplied with the following three-year warranty subject to the restrictions contained in this clause.
- Nothing contained in this warranty operates to limit any rights available under consumer protection legislation. The main rights available under such legislation are:
- Any goods supplied will:
- Match the description given to them;
- be of satisfactory quality; and
- be fit for the purpose for which they have been supplied
- any services supplied will have been carried out with reasonable skill and care.
- FAILURE TO COMPLY WITH ANY OF THE PROVISIONS OF CLAUSE 6 SHALL INVALIDATE THIS WARRANTY
- Armadillo warrants that subject to the restrictions contained in these terms the Armadillo Parts shall be:
- Of satisfactory quality; and
- Fit for any purpose specified in the sales and marketing literature produced by Armadillo in relation to the Armadillo Parts.
- This warranty begins on the date of delivery of the Armadillo Parts by Armadillo and expires on the date 3 years after the date that the Armadillo Parts are dispatched by Armadillo to you.
- The extent of this warranty is that Armadillo shall repair or replace at Armadillo’s option any Armadillo Parts which fail to comply with the warranty.
- This warranty does not cover;
- failure or breakage of any Armadillo Part where the failure or breakage of that Armadillo Part is caused primarily or in whole by wear and tear; or
- damage to any Armadillo Part caused by the failure or breakdown of any part which is not covered by this warranty; or
- damage or breakage of any other part caused as a consequence of the failure of breakage of the Armadillo Part; or
- third party liability or any liability for death or bodily injury or damage to Property of any description caused by failure to use the Armadillo Parts in accordance with the instructions at clause 6 below; or
- failure or breakage of any Armadillo Part where the failure or breakage of that Armadillo Part is caused by incorrect fitting and the Armadillo Part was not fitted by Armadillo Concepts UK Limited.
- failure or breakage of any Armadillo Part where the failure or breakage of that Armadillo Part is caused by failure to use, maintain or service the Armadillo Part in accordance with the instructions as set out at 6.
- Notification of claims
If you need to make a claim under the terms of this warranty, please contact Armadillo within 30 days of becoming aware of the failure or breakdown of the Armadillo Part. - Prior to operating the Roll-Top Cover you must ensure that you have cleared large debris such as leaves and twigs.
- You must carry out the following maintenance every six months and at each prescribed service interval:
- apply a lubricant to the lock mechanism
- with the Roll-Top Cover closed and the tailgte open, use a torch to inspect the condition of the tape strips applied between the aluminium slats.
- check that the side-rails are clear of dirt and debris
- Ensuring the Roll-Top is closed and locked, removed the Roll-Top housing cover (using a cross-head screwdriver to remove the two security screws) and clear the housing of any debris and dirt. Replace the housing cover and secure with the screws.
- Remove drain pipes by simply pulling from the drain plugs, cleaning if required, and then refitting.
- Roll-Top Cover – Health and Safety
In order to avoid death or personal injury to you or anyone else you must ALWAYS have regard to the following safety instructions: - When driving around with the Roll-Top open, ensure the retraction strap is secured inside the load bin. A loose strap can cause serious injury if allowed to lie loosely around the vehicle while driving.
- Do not carry persons or animals in the load bin at any time
- Ensure that the load bin aperture is clear of hands and other obstructions prior to operating the Roll-Top
- Do not place additional loads on top of the closed Roll-Top
- Do not operate with Roll-Top housing cover removed.
